Marchant had been charged with two counts of negligent homicide, driving on a suspended license and no insurance, but he entered a no contest plea to the homicide charge last month after prosecutors agreed to drop the remaining misdemeanor offenses. The defendant was accused of leaving his dump truck parked partially on a narrow road on Jan. 24 in Hooper in west Weber County. A car driven by Eddy Gortcinsky, 42, slammed into the back of the truck, killing him and his 14-year-old daughter, Dani Lyne. Gortcinsky's wife, Adrianne, was seriously injured.
