A preliminary hearing has been scheduled for a man accused of raping his mother and then clubbing her to death with a baseball bat.

Andy Leon Vigil, 19, was ordered to appear Nov. 21 before 3rd Circuit Judge Eleanor Van Sciver. The Salt Lake man is charged with first-degree murder and aggravated sexual assault in connection with the beating death Sept. 2 of his mother, Juanita Madrigal. He is also charged with rape of a child and object rape of a child in connection with the rape of a 4-year-old girl.A witness who was in the apartment at 564 E. 600 South No. 1 said he woke up that morning after hearing the 4-year-old crying. He heard what sounded like a slap and a male voice saying, "Shut up, or I'll hurt your brother." Vigil then went into Madrigal's room with a baseball bat, according to documents filed in 3rd Circuit Court.

The witness said he heard several "hitting sounds." He heard Madrigal remind the defendant that she was his mother and that there was a 1-month-old baby sleeping on the bed with her, the documents say.

After the incident, Vigil told the witness to call police because Madrigal had been hurt. Vigil then left the apartment with the baseball bat and returned moments later without it.

Madrigal, 40, died later that day as a result of head wounds, according to the state medical examiner.
