In the world of competing claims, the fact that X developed its property first shouldn't prevent Y from developing its property as well. X doesn't own the air rights outside of the imaginary cone that is X's property. Consequently, the only way to deal with the problem of industrial pollution is through zoning and planning - which of course Utah citizens and governments generally dislike, particularly the planning part - try getting a city to follow its general plan. In the case at hand, once Stericycle and the community allowed housing to encroach, the company was doomed.
