I agree. The Human Rights Campaigns comments were misguided.

So are many of the comments I have read (including from this newspaper) about Judge Shelby. It's wrong to criticize Mr. Shaerr's motives for taking the case and it is wrong to call Judge Shelby an activist judge with an agenda. It is wrong to suggest, without facts to support the claim, that the plaintiffs lawyers somehow cherry-picked the judge to hear the case.

Rule 3 of the Utah Standards "of Professionalism and Civility reads: "Lawyers shall not, without an adequate factual basis, attribute to other counsel or the court improper motives, purpose, or conduct."

I know of no factual basis to suggest that any of the attorneys involved, or Judge Shelby, have acted with improper motives or purpose.

I find it interesting they call themselves Human Rights Campaign, but all they care about is sexual orientation rights.
