Ned is correct. Even a cursory review of the Utah code reveals that there are a great many crimes that have been classified as misdemeanors or felonies in seemingly arbitrary ways. Sadly, in many cases such as this, it is not arbitrary, it is the result of lobbying by left-leaning extremists.

Utah is one of the most right-leaning states in America, but you say left-leaning lobbyists are successful here? Ha! Good one!

JCS: I think it would be better said that it is the result of lobbying by "those that hold the cash", left or right, because BOTH sides play the game. Cash talks in the world of politics, even when it is not necessarily in the best interests of the masses. (Move the prison to benefit insiders, buy a congressman to avoid legal actions, hire a legislator to bolster your trade group...)
