This lawsuit is a non-starter, and the attorney for the deceased suspect's family is going to have to look elsewhere for income because there isn't going to be any out of court settlement.

A little fishy. You have a 78 year old lady who says she was too far away to "see" if the taser was used, but close enough to hear him yell. I would think this case would be very simple. Once the ME releases the autopsy, is there taser marks on his chest? If there is than proceed with the lawsuit. If no marks, than drop the lawsuit and this is a fishing expedition. Should be open and shut.
