Blow out preventers are tested on a regular basis.

The fact that the BOP in question failed with so many problems points to the likelihood that the drilling contractor falsified test records prior to the accident, probably at the bequest of the oil company.

The failure was British Petroleum's. There's no excuse other than greed and hubris that explains their actions and poor safety record.
