There is a process and it appears the judge wants to have his case go to the Supreme Court to have them decide against the previous sentencing guidelines.

The Supreme Court made a decision in 2005 that the Department of Defense didn't believe pertained to them and their employees. They have spent years trying to get around that decision and violating environmental and safety and health rules and regulations to get around the decision.

This sounds very similar but still different. This is a federal judge believing he can get around sentencing guidelines.

The federal government at various levels and jurisdictions believe they are above the law. Law and order is a time value system. It doesn't have to have that many changes over time, just fine-tuning.

Moral issues the government is trying to use now when they don't have integrity and morality as a core value in existence on in words and sleight of tongue.

We elected people who appoint judges that believe they can get around the law that exist and signed into law. If a law or the guidelines aren't correct, you don't make a bad decision better.
