Part of the problem is politics. The GOP would be stirring controversy no matter what the process was.

Ever heard of the Miranda warning? I betcha he wasn't Mirandaized before his confession of Pearl's killing was recorded. In a criminal trial that video will be inadmissable if he wasn't Mirandaized.

Why doesn't the government stop any terrorists or bring any to justice? Beats me but things have to change. All we have are acts of Congress (the "Patriot" Act and NDAA that take away the rights of American citizens and legal residents.

Cuz we're too busy invading countries like Iraq who had nothing to do with 9/11.

Well...maybe according to the Geneva Conventions, KSM should be considered a prisoner of war and tried by military tribunal: He led a group of foreigners in an act of war against the US, he was apprehended outside of the US and was not read his rights. In addition, in a civilian US court, his confessions elicited by torture--he was water boarded 183 times--would not be admissible.

The US has played fast and loose with the Geneva Conventions before and in this case, should try KSM in a civilian US court, regardless the challenges, where the press, media, and the public are welcome. It's quite possible that KSM would provide a few more truthful answers than what we have been led to believe about why they attacked us. I'm convinced this is the real reason why the US is unwilling to bring KSM "to justice."

One simple reason -- the liberal, hate-America-first crowd that controls the Democrat Party and the Obama regime derives a sybaritic pleasure from American weakness. Even when it's contrived. By them.

It reinforces their disingenuous "chickens-come-home-to-roost" argument.
