Very sad. The story is misleading because it claims that Dr. MacKay's actions led to the death of one individual when in fact that person who died was (unknown to Dr. MacKay) using illegal drugs at the same time, and it was the combination of the legally prescribed drugs, along with the illegal substances, that killed that person!
Dr. MacKay's case is one of Federal Government overreach and persecution. Federal attorneys on "autopilot" out to make their careers and promotions, and not to really be concerned about the "Truth." How the DEA and federal law enforcement treated MacKay and his family with their no-knock raids, sticking guns to their heads, confiscating all their assets for over two years without bringing any charges against MacKay....and their main witnesses were very suspect and admitted addicts.
No, this is a case where justice was not well served. MacKay's life has been one of service to the community and his country and he was treated shamefully.
I don't care how much of service to the coummunity, and country, it doesn't give him the right to break the law and if a doctor can't tell a person is abuses drugs it doesn't in my book give him much credit as a doctor. I have been on pain medication and had to have blood work to make sure it was working proply. i am glad that he has given up his licenses to pracitice mediciene, and surgery and to dispenese control medication. I believe that he should have to report to prison and start severing his sentence, and I don't want to hear how sick he is he needs to start severing his time and paying his debt to society.
Dr. MacKay really needs to be in prison during his appeal. The judge let us down when he allowed Dr. MacKay free on appeal. These appeals can take months or even years. Other drug criminals are sent to prison on conviction. Why does this man get special treatment. It's like he got a 'get out of jail free card' from a judge who received numerous requests from the doctor's friends, neighbors, and politicians. This is wrong. Very wrong indeed.
I noticed that Trooper 55, living in Arizona, probably is in federal law enforcement, doesn't live in Utah and likely doesn't know anything at all about this case or Dr. MacKay, unlike many of us in Northern Utah in Box Elder County who know and respect Dr. MacKay for decades. Every single doctor (except 1) in Box Elder County and many in Cache County have written to the court affidavits, glowing affidavits, of what a great doctor he was and a person of integrity.
People who "testified" against MacKay were addicts, and were mad because he would NOT renew their scripts for meds. The government had to get one of the witnesses out of jail and paid her to testify.
THis was all about the federal government, and the DEA, to crack down on doctors who are in the field of pain management. It wasn't as much about MacKay as it was the larger "example" to be made. Individual rights and the truth were the casualty.
Yes, it does and should make a difference about his service record and exemplary life. He was sentenced to 20 years. We don't even put Convicted Murderers.... away for that long! The judge had no choice because of minimum mandatory sentencing. And in this case, it was an injustice. MacKay was outgunned by the big federal government resources, and they cherry-picked the jury.
I noticed the Salt Lake commenter too, wasn't from this area. Probably doesn't know a thing about this case either. I lost a lot of respect for DEA, FBI and Justice Department in this case as I konw a lot about it. They were abusive. Heaven forbid any of us get in front of that railroad job.

No I am not a fredal law Officer I am a retired State Trooper from the south that have retired with over 28 years as an State Trooper, and I worked with the Fredal Drug Task Force for over 8 years. The doctor broke the law and was convicted of the crimes he was charged with. I don't care how much good he did for the coummity he lives in when you do get convicted of the crimes he did he got what he needed and should start severing his sentence. I have been on medication for pain and doctors like him is some of the reason it's now hard to get. He failed to follow a good practice that is do blood work from time to time and just maybe he would of found out the person that die had a drug problem and maybe alive today. Today I walk with a cane and sometime two, because of injuries I recived doing my job. The Justice has problems and until their changed it's the best we got and I support them.
