First off don't drive if you are going to have more than a couple of drinks. Second if you do get pulled over, refuse to do any sobriety test. You might lose your license but you can not be prosecuted and convicted of a DUI if they have no evidence. Plus you will lose your license anyway if you are convicted so don't do anything to help them out.

Refusing a breathalyzer or blood test isn't available if you've just killed someone because you were to blitzed to stay on your side of the highway. Instead of worrying about how to avoid a DUI conviction perhaps were should be a little more concerned about saving the lives of innocent people who have the right to life.

Shaun, personally I don't think anyone should drink any level of alcohol higher than you find in things like orange juice, etc. and then drive. If you intend on partying or living according to that lifestyle, the responsible thing would be to take every last precaution to not let that lifestyle be at risk of causing harm to others.

Refusing to allow the police to protect US as a society is wrong. Preaching that to others, in my opinion, is the same 100 fold.

If you want to live in a lawless society where no one has any authority and everyone can live without consequences- I understand that. That is your right to desire such a society. But this country has shown that we don't this. You are welcome to go elsewhere.

Further, this state- our state, my state, has chosen to accept the foundation of a lawful society. If you disagree, that is your right. But acting on that disagreement comes with consequences, even legal consequences. If you want to live elsewhere, again you are free to do so.

But I'll conclude by kindly asking you to either respect those you live around and our rights, or leave.

@Voice of reason. I don't think people should drink and drive and I think it is dumb if they do.

Just because someone refuses to do any sobriety test does not mean the police can not protect the public. It doesn't mean they can not take them to jail. All it has to do with IS not giving the prosecutor evidence. If somebody refuses to give a sobriety test they almost always lose their license regardless if they are convicted of a DUI.

You talk about a lawless society but any individual has a constitutional right not to incriminate themselves or answer questions during an interrogation. People who get pulled over for what ever reason have a right not to answer questions or incriminate themselves.

No, "dumb" is the wrong adjective. Stupid, criminal, and uncaring better describe the behavior. "Dumb" doesn't get you arrested and sent to jail, and "dumb" doesn't drain your banking account in court costs and fines.

Its how people drive and not what they say that incriminates them.

When I lived in Germany, if the Police pull you over for DUI and ask for a BAC, you have NO CHOICE. The will get the blood with or without your permission. Either with a needle or a night stick it is all the same. I loved the law while there, I felt much safer on the road than I do here. We need to do some serious cracking down on these idiots.

I am glad to see that they got the funding they needed to put more Troopers on the road and the arrests that were made. I was always on duty during the Holiday weekends when I was a Trooper and I still believe that they need stiffer pentlies for DUIs and harsher laws when lifes are lost to drunking driver that kill people in accidents. I also believe if the offenders are made to go to accidents that lost of life or injuries reult from drinking and driving, or when we have to go and tell a love one that they lost a husband, wife or children that was the worst part of the job for me, goig to that door. Re: Shaun the advice you are telling people maybe right, but I hope you never lose a love one to a drunken driver, I know you will change your tune after that, you don't hold much value on the human life to save what you have. I agree with the one post go live somewhere there are no laws. good luck in finding the place.

People should not drive under the influence of any sunstance that impairs ones ability to drive safely. It is within ones "RIGHTS" to refuse sobriety tests when pulled over as long as there is no personal injuries or property damage connectedf with the traffic stop.

shaun_ in St. George may sing a different tune someday if he or a loved one is ever injured or killed by some drunk driver who has gotten a slap on the wrist some time in the past for refusing a breathalyzer test because he couldn't keep it between the white lines on the road. That's when liberals convert to conservatism.
