This argument is quite a reach for Mr. Johnson to put forth and flies in the face of general case law
decisions. It will be interesting to see how this plays out in court, and most likely at the appellate level as well.

That issue won't play out in court, it's not a major issue for Gibby. He doesn't care about the airstrip, he's just using it as a tactic to get other things he wants. Besides, that's not the city's basis for denying the airstrip. They have every right to deny the airstrip.

you are wrong about that, absence of law doesn't = entitlement rights to zoning, no city in this country has a list of land uses not allowed... said list would be never ending. Instead the language in every city ordinance ever written says something to the effect of: if it's not expressively allowed by code, you don't get to do it. So if an airport or airstrip is not listed as a prohibited use in Mapleton's land use code, wont matter one bit. There is ample case law on this. Look it up.

I live near Gibby and have worked with him in the past. He knew what the zoning was when he bought the property. Zoning changes are open to public discussion and the public has opined for years against this.

For Gibby this is all about power and ego. I hope his Bishop has been watching and listening. A man can outright lie to his Bishop about being fair in his dealings with his fellow man. As blatant as his activities are he should be facing a Church court.

The courts have told him to pay the City's attorney fees and he responded to the City "over my dead body". Hmmm, maybe he should be taken up on that. No one has the right to claim that his property rights outweigh the rights of his neighbors. I would hope that the supreme court stops him in his tracks.
