Fair trial? | 9:57 p.m. Oct. 26, 2009
Doubt it. Just because Mitchell blew his chance with his "insane" tactics.

While Mitchell held up the proceedings with his fake "incompetency" Elizabeth & her family were vilified all over the Internet. When the trial finally begins chances are that everyone will be prejudiced against the Smarts. Which is what I'm sure Mitchell was hoping for.

The last few paragraphs of the article confused me more than enlightened me. I think more information could have been offered to educate readers on the information.

There is no reason for the details of the horrors this young woman, a child at the time of assaults, need to be released. The "press" should be ashamed of violating this young woman even further. There is no need for the "public" to know any more details. Mitchell is a fraud and a fake and anyone with half a brain knows it so try him and sentence him to the maximum. Why continue to victimize the victims in this case.

This is why our legal system is flawed and has no morals. Yes he has a right to a free trial, but em, he kindnapped and molested a 15 year old girl, and by doing so should have kissed his rights good bye. The defense attornys only care about the publicity of being able to get this guy off the hook. Which i hope wont happen. I applaud the Smarts for seeking justice. The Defense needs to take a long look at themselves in the mirror.

You can't "kiss his rights goodbye" until a jury says, guilty

Actually Elizabeth was only 14 when kidnapped.
It seems odd that the defence is trying to exclude just about everyone from the hearing on Mr. Mitchell's competency.
I say the more people the better. We will get closer to the truth if we allow the most statements possible.

I am not an advocate for people, who are guilty getting off, but when the tables are turned and you stand in front of the judge you want to make sure all you rights are intact. It for the protection of the innocent that the rights are in place so we are not railroaded on trumped up charges. The best thing that can happen is for those who are truly guilty to stand up and take responsibility for wrongs they have committed, which unfortunately is something they have not done before in their lives. If you want a good criminal justice system then start training your children to take responsibility, by accepting the consequences for every mistake they make. This is why the criminal justice system has so many problems no one wants to take responsibility. The other problem is greed among the attorneys that want payment for services rendered and cannot get them if their client is sitting in jail. The law requires a zealous defense. Remember don't every break the law and you won't have to be part of a criminal trial unless you are on the jury. The burden of proof is on the prosecutor.
