seat belts don't always save lives... sometimes they can actually be the cause of the loss of life. but most of the time they save lives. she was wearing a seat belt.

The woman killed in this car accident was my aunt. And I know for a fact that the tires on that van were fairly new. A blow-out can happen even if you just purchased your tires, nothing is guaranteed. There could of been something on the road that caused it. Please don't comment on things that you don't know, it's hurtful enough that we lost a family member in this way.

Very sad for the family. The woman killed was wearing a seat belt yet she was partially ejected from the van? Sounds like the seat belt failed to me which mean law suit against the Van maker.

Wow..to the family this very sad, my heart goes out for you all, i would have waited 12 hours in a traffic jam if it would of saved her, very sorry

Dear Marie:

There was no offense or insensitivity intended in a prudent warning. Everyone surely is sincerely sorry for your loss. Such a loss is the most difficult burden to bear in this life; the loss of a loved one.

No harm was meant responding to the details in the news report. Moreover, if what you argue is true, that the tire was in new condition, and there is nothing on the road “forensically” to have caused the tire to blow, then you should have no problem whatsoever in bringing a wrongful death and/or product liability action against the tire distributor where the tire was purchased and it’s manufacturer. As a “Forensic Specialist,”(all things being equal), I can safely say that.

Nevertheless, it is a matter of fact, according recent news articles by the Tribune and Deseret News that tire sales are down due to the economic impact of the recession. People are putting off replacing tires when they need to be replaced. Generally, people are driving with worn and unsafe tires.
