I don't understand this story. Did he serve his five years? If they overturned it and he already served his time, why would they try to retry him... Did I miss something?

SPK

What? Poorly written, half of a story. :( Leaves more questions than answers.

I am with anonymous I don't get the story. If he served his five years... What is the problem???

Anonymous

He probably served his time and was released but he would want to have the conviction overturned since many of his rights are limited if he is convicted of a felony.

The prosecutors have a right to retry the case if a conviction was overturned even if he has already served his time and may choose to do so for several reasons including wanting to guarantee that he is on the sex offender registry and to prevent him from holding public office or owning a gun.

Time

I doubt he ever served the time..The conviction was overturned and he was released pending an appeal that took 21 years. That is the only stupid thing here. 21 years for an appeal decision. That is ? I'm not sure what to call it. I remember the case. He should be retried.
