It is unbelievable but not unexpected from a government so corrupt we can't even get to the truth through the branch that supposedly represents a check and balance to the other two. The entire system needs a thorough disinfecting. They have a rotten stench about them.
To be entitled to take the deposition, the question is not whether the inmates have direct evidence; the question is whether they could offer testimony that might itself lead to the discovery of admissible evidence. The Tenth Circuit is wrong and should be appealed. Sunshine is the best disinfectant.
