Supreme Court members shouldn't make law? Show me one justice who didn't make law in the last 100 years.

rightascension

oh b-ur=uther! I am amazed that Our Senior Senator can say silly stuff like this with a straight face.

If the Republicans thought abortion on demand as birth control was so-o-o bad, they should have outlawed it with a constitutional amendment instead of relying on the Supreme Court. Besides, if the Congress did not pass such badly written and ambiguous law, then the Supreme Court wouldn't have to read tea leaves.

Thanks Hatch!

You believed Pres. Obama about only getting a 'Pragmatist' ... you are in a pickle now, you voted for her before, now how can you vote against her & still save face .... another reason you (& Bennett) should be voted out of office!

ah yes

Orrin, your opinion, though freely stated in a free society, is no longer valid. In fact, it wasn't valid years ago. It is a sorry state of affairs to watch a gop member attack Obama's nomineee: who initially was appointed by some guy named President Bush (senior). Yup, look it up people.

Oh, Orrin, you are so slick by half. Do the people ever catch on to your game?

Lute

What the Senator means is: "The Supreme Court Justice shouldn't make law without consulting with me first."

Hatch Translated

If a Supreme Court justice makes a ruling that Hatch does not agree with, he/she is "making law". If Hatch agrees with a ruling, the justice is upholding the law.

Hatch's "making law" argument is tired and meaningless, kind of like Hatch himself.

Aaron

Go away Orrin. Just go away. You are well past your expiration date (along with the vast majority of your colleagues) when it comes to judicial prudence. You wouldn't know an unqualified candidate for the Supreme Court if she walked up and exclaimed that a Latino woman from the streets would make better decisions than a rich white male. Oh wait. Sotomayor actually DID say that...

Oh, quit flogging this dead horse, Mr. Hatch. You presume too much, and try to accuse nominees of things that are just your own pet peeve and bias in order to play political games.

Mike

A good conservative would "put a hold" on her nomination, just like Hillary and other democrats have done to Bush's judicial nominees. Let it drag out. I can't wait to see her income taxes, or her nanny problems.

Re: ah yes

Your logic is rather silly considering there have been 11 years of ruling since the last appointment, not to mention that there is a different level of scrutiny that is given for a supreme court judge than there is for a circuit court judge.

Neal Kramer

On Senator Hatch's recommendation, let's begin the impeachment process for Justices Roberts, Alito, Scalia, and Thomas. All they ever do is make policy.

Oh, wait. Every time they make a decision about how law is to be interpreted and enforced, they make policy!

They're just doing their jobs, as Senator Hatch knows all too well. He just wants judges likely to support his agenda. No Senator in this generation has done more to politicize the judicial confirmation process than Orrin Hatch.

What a grat pick and a great day for our country! I hope she serves on the high court for 30 years. Lets hope that just one of either Scalia, Thomas, Alito, Kennedy or Roberts calls it quits before the end of Obama's second term. What a great country we live in!

Robert Bornmann

If judges only followed the what the people thought as law then we will still have segregated schools. The judges have to use judgment of the constitution and not the popular ideology to make decisions. Lets understand that interpreting the law and making ruling in favor of supporting the freedoms and rights of another is not "Law making" it is justice.

Your ad hominem attacks against Senator Hatch are pointless. As for me, I will encourage Senator Hatch to scrutinize Sotomayor's past history of interpreting or making law from the bench. Judges aren't supposed to make law. Just read Article I-III of the Constitution--it's not that long. I hope he reviews her past statements and decisions. We need to understand whether in the past she has allowed U.S. citizens and our elected representatives to make the law.

why interview Yapias

Why does the local media have to interview Tony Yapias? As a Latino, I do not consider him my "leader", nor does any Latino I know. I know he does some great things, but I do not agree with the local media going to him for a statement in regards to this.

Ten Bucks

My ten bucks says that the first 8 or 9 comments on here are written by the very same poster.

They're all back to back time-wise and they all slam Sen. Hatch.

Big surprise...

Re.: Ten Bucks @ 11:51am

I am poster #3, you owe me ten bucks, where can I pick it up from you?

Chance

Come on now people, you knew this could happen. Conservatives know dang well how this judge has ruled in the past and what she is capable of. She is a flatly liberal activist judge. It is well known. It is ridiculous to say that just because she makes decisions we disagree with, that she is legislating from teh bench, fact is, conservatives do/will disagree with her methods and principles, well documented. Orrin is right to question.

lost in DC

I think it's very telling that sotomayor KNEW she should not have said what she said about making policy. It was tacit admission that the judiciary has waaaaay overstepped its bounds, but she has no problem with that. Very poor choice by BO and a telling lack of discression (if nothing else) by sotomayor.

Micawber

Chance,

Which decisions that Judge Sotomayor has authored do you believe support your view that she is a "liberal activist judge"?
