After seeing many of these attacks, I'm 99% sure it was malicious. Many of these attacks are carried out by hidden frames in the web page that redirect the user to another web page that downloads the malware. Many times the code is "injected" or added to portions of a legitimate website that users can post text to(like this comment section), blogs, ads, etc.
Good luck with the site.
Google usually removes the flag within a few hours when webmasters request a review and their sites are found really clean.
So either Herriman site is still infected or its webmaster is too lazy to request a review.
