It took from 2000 until now for the Federal court to sort ot the case of 13 children. It will be a long haul for 440.
What the heck.....at least CPS can be held liable for for not following the law. What do you want to bet that there will be a case where CPS claims the new ruleing hindered their ability to save a child.

The nonsuited ones are still under "investigation and supervision." Is that the permanent sex/child abuse category that CPS puts on parents' record for life, making it easier to remove their kids next time around in court, and of which the Gates family spent $400,000 trying to clear their name?

CPS is pseudo Law Enforcement agency. Conducting law enforcement without granting parents the minimum ordinary protections afforded by our Bill of Rights that even ordinary criminals expect.

I thought about what you said in a post on another article, and after considering it, I agree with you.

I shouldn't worry about these kids being denied a decent education and being isolated from the world.

The smart ones will get out and the stupid ones will stay. So in fact these parents are doing us a favor but putting less idiots out in the general population.

Thanks for getting me to think about it from another angle. And thank you FLDS parents for keeping the children of the corn out of our way.

CPS - leave them alone. They're doing us a favor.

I'm not blameing anyone for the 8 years. It always takes a long time. The court system never misses lunch.
Now...for you conspiracy theorists. The decision from the 5th circuit was delivered three months ago. Does anyone think CPS moved on flds before they had their hands tied. Add up all the wierd circumstances and run with it.

Realitycheck - It's "fewer idiots", not "less idiots." "Fewer is used when the objects are countable. "Less" is used when the object can not be counted. "I drank less water than yesterday."

PS- I've enjoy your posts. But, when people make grammatical errors while implying that someone else is not too bright, I can't help but comment.

Don't sweat the small stuff Joey. After a case has been finished the paperwork and records can be destroyed at the request of those no longer under investigation. I am sure the lawyers are handling the situation.
I sure would like to know the technicality that lost it for the parents in the Federal case.

thanks for the old-school english lesson, but you need to get with the new english, girl. they can be used interchangably in the real world. only an english teacher would say it's wrong, because they still use books from 1970... but in 2008, you can say it either way. we're much less strict now, especially in texting, etc.

no offense, but that was a lame comment. being a slow FLDS drone with a 5th grade education versus using an interchangable word incorrectly are two totally different things. hopefully you would recognize that...
(note that I didn't use caps and probably have some run-on sentences. that's ok in 2008, unless you're writing a book or letter or something else official. we're just talking here, girl.)

If a parent doesn't protect one child. It is more than likely that they will fail to protect the other children in the home. It's really a no brainer.

Gal50 - actually there's nothing wrong with using "less" in this instance since they cannot be counted (I have no idea how many there are....)

Actually, CPS is the law because judges dont even take the time to read the case. They ask the CPS agent what he/she recommends and then act solely upon the CPS agent's recommendation. There's nothing wrong with taking abused children from abusers. There is, however, something very wrong with taking loved, healthy children from their parents and placing them with abusers. Many children that were never abused at home are abused in their foster home. The fact that the children are shuffled from one foster home to another increases the chances for abuse. What is truely sad is that some children were genuinely abused by their parents and now are suffering abuse by the state. These little ones never know what its like not to be a victim.

it is sad that this ruling fails to consider the harm that will come to children whose parents are abusive and may result in untold number of deaths. parents will hide children, not participate investigations and children will not come forth for fear their parents will deny which they already do placing them further in harms way. when enough children die/get killed perhaps this will change
