The UEP is now being well managed. It appears that the manager would like to distribute the money as equally as possible and not hand it out in large lump sums to victims. I think Elissa Wall's attorneys are correct though. This is in essence the bank account of the FLDS.

Rod Parker's stance is very interesting. It is clear there is some legal issue that must be ruled on by the courts. He is smart to protect his law firm. Did he work for the managers of the trust or did he work for the trust. If the former, he can't release documents, if the later, he can. His position counter to the trust manager's will force a judge to decide the issue.

It is unclear as to how the outcome of his case will affect Elissa Wall's case. While one outcome may be better than another, it seems she is still entitled to a settlement from the trust.

The Catholic church paid out its damages from money collected from parishioners and the UEP is a collection of money from members of the FLDS. If a court rules in opposition, the Catholic church will surely take note.

I dont see why they can keep claiming it is the same trust. They did disolve the original UEP trust and form a new one. Just because it has the same name and owns the same land as the last one, does that let them claim to acctually "be" the old trust? and claim the rights of the old one?

Actually the trust wasn't dissolved. Denise Lindberg, Bruce Wisan and his lawyers are simply a band of pirates that jumped onto the ship. Now comes a new band of pirates - and we get to see them fight each other. How true indeed that "the Lord moves in mysterious ways."

Yes..the original trust WAS dissolved and new articles of trust were drafted

If you have a trust then it is no good anymore. They can steel it from you just because they don't like you.

It doesn't matter that management of the trust changed. It maintains its liabilities. Every trustee in legal trouble would simply shift the trust to new management otherwise.

Two things are occurring:

The current trustee is asking the law firm that represented the previous trustee to pass on records. This would normally happen as a matter of course.

The current trustee has a fiduciary duty to protect the trust's assets. He is
doing that, though his argument against Ms. Wall will not prevail.

Money money! the main concern here or should be is the stealing of church property. The UEP was taken from people we trusted and given to "some government official." now he intends to split it up sell the land to individual home owners and make as much profit as possible. since the UEP has changed hands our taxes have doubled and there is now a monthly fee along with a occupancy agreement that says a UEP official can come in to you house or yard any time they please. To be fair they do have to give you a prior warning. I believe that people carry good or bad spirits and I would like to be sure that my home has only good spirits enter in it. I want to choose. I have a right to say "NO!" No wisan I don't trust you. That is something you earn. It's not served on a silver platter like the UEP was.

Yes the trust is well managed, and wisan is well pleased how large his bank account and land holdings have gotten
