Funny thing about that dissenting opinion - the standard is "a person of ordinary prudence and caution" but only 3 judges out of 9 signed on. Looks like the other 6 know how a person of ordinary prudence and caution would feel!

The 3 dissenting judges are extra-prudent or extra-cautious perhaps - the exact kind of trigger-happy people that started the whole mess!
texas court stinks | 6:03 a.m. May 30, 2008
The court overlooks all facts and them claims the state did not prove it's case. SICK ! The all flds moms and dads follow and worship a child rapist and teach their kids to do so as well ! The Texas supreme court erred big time and should be held accountable for ANY abuse these flds kids encounter in the future! This is sickening !
spud | 9:17 a.m. May 30, 2008
What's sickening is your inability to follow this story. Listen I know Nancy Grace is cool with all of her fly by graphics and intro song, but she's not real news. Why don't you turn off the tube and look up the Texas Supreme Court's website and read the appeal and the rebuttals. You will see that the states case was not made, and was effectively argued against.

Polygamy has not won | 1:03 p.m. May 30, 2008
At all! In fact, as we speak there are many girls that have excaped this lifestyle. There are many points that are made that are off the subject. Yes, there is some abuse in general society. That is not the point. Yes, there are young girls that have sex and sometimes get pregnant. That is not the point either. The point is that men cannot tell young girls that they must "marry" them and have sex with them to go to heaven! This is abusive and disturbing on so many levels. This mind-set will not succeed and is being defeated.

A license is offical or legal permission to do or own a specified thing. A marriage license is a three party agreement between the man the woman and the state and is regulated and controlled by the state. The state acts as a god in that it is a law maker. The first commandment says thou shall have no other gods before me. Polygamy is the condition or practice of having more than one spouse at one time. To do this with out a license and by private contract falls under constitutional law or common law. Bigamy is the criminal offense of marrying one person while still legally married to another, that is having two marriage licenses at the same time. These licenses are public contracts and fall under administrative or admiralty law.

I THINK texas should get sued for the texas roundup .ICAN TELL YOU that you dont have any freedom in the usa.I am a 64 years old and had my rights violated for years only because of my IQ.
Sorry to hear about rights | 8:39 p.m. May 31, 2008
"violated" because of IQ, but the subject of this is how to deal with young girls being told they have to marry older men with multiple wives so they can get to heaven! These girls have having their freedoms taken away.
rights | 9:00 a.m. June 1, 2008
The problem is that many believe the CPS story that underage girls are all marrying old men. This is not supported by fact as well as the CPS story that a 27 year old was a minor. How many lies does CPS have to tell before you stop believing them? The facts are that most young women marry, at legal age of consent and to men near their own age. A few seem to have been victimized but the rate of victimization is still significantly lower than the numbers throughout TX which has a 14 year old getting pregnant every 10 hours. All this seems to have been was distraction and an attempt to get at FLDS funds. Why? Because we all hate them. That isn't enough of an excuse for me since I am also a minority in that I am agnostic. Am I next? Who will be there to protect my beliefs, or lack thereof?
re: rights | 8:49 p.m. June 1, 2008
Yeah, you're right. We should not believe all those CPS lies that underage girls are marrying old men. Forget you ever saw those photos of Uncle Warren making out with a 12 year old.
RIghts | 6:25 a.m. June 2, 2008
Uncle Warren is living in Draper, UT, not in TX. By now he might actually have been moved to AZ for trial number 2. Or did you forget that part? He has been incarcerated for quite some time, which I am sure you also forgot. Did Warren kiss those same girls, or did he have sex with them? It seems a kiss was all he did. While that is disgusting, it is not illegal. Again though, the Bishop's records show that most girls "marry" men their own age and not "old men." In TX a 14 year old gets pregnant every 10 hours outside the FLDS community. I am sure none of those girls got pregnant by the men whose children they babysit or are their best friend's daddy without benefit of CPS "protection" written with sarcastic intent. The latest news is that a 29 year old was relisted as an adult. It seems CPS can't distinguish a minor from an adult with legal documentation in hand. So again, how many times does the CPS have to lie before you stop believing them. Also look at the Supreme Court majority ruling in which the court lists another CPS screwup.
Grandpa Phil | 6:41 a.m. June 2, 2008
To: "re:rights", I agree, CPS has stretched the truth FAR too many times to have any degree of credibility left. As for the photos of Jeffs and the girls, those are already forgotten. They are irrelevant to the case at hand and should never have been submitted by CPS in the first place. Whatever Jeffs has done, Jeffs can pay for, period. For people to convict the entire group over the actions of one man is irresponsible. CPS hoped to get the sensational journalism effect out of the pictures and it worked on those susceptible to that blatant form of miscarriage of justice.
Hey Grandpa Phil | 4:38 p.m. June 11, 2008
Warren Will Pay for everything he has done that is wrong. HE HAS DONE NO WRONG!!!!!!!!!!!
Amazed | 6:37 p.m. June 14, 2008
I am amazed how people condemn out in the open polygamy (the majority being loving homes, and in the practice of faith), and casually dismiss the deceitful adulterous acts of themselves and those they know.
Morality is dictated by the Mob.
Ethics are subjective.
Ignorance breeds fear.
