Good for the legislature. Keep the ambulance chasers from profiting from the misfortune of others. If someone's roof leaks, there is no reason for them to get a free trip to Maui for it, and there is no reason why these construction defect guys should profit either.
Not all attorneys are ambulance chasers. Many defend innocent home buyers who stand to lose their most important investment. Most homebuilders deliver good product and value. Unfortunately, this bill will shelter the minority who do not.
The Community Associations Institute Utah Legislative Action Committee tried hard to defeat this bill or get it amended to protect the rights of home buyers. We could not compete with the power and money of those behind this bill.
Anonymous wrote that someone who has a roof leak doesn't deserve a trip to Maui...this is tort reform propaganda. You don't get a trip to Maui, you maybe, if you're lucky, recover enough to fix your roof. Lawyers cost money, experts cost money, and repairs often must be done before you win. IF you win, you may never collect. Marla's right, it will protect bad builders. This industry can't do a good job self regulating, and it fights real regulation. Don't fall for this line of baloney that builders need protection.
Anyone who believes this is good legislation deserves to be a victim of a home builder who likes to cut corners to add to their bottom line. If you build enough houses and leave out the roofing felt, window flashing, and rebar in the foundation it does add to the bottom line. These actions nearly always allow water intrusion that can destroy a homeowner financially, physically, and emotionally. They deserve to have some recourse.
This legislation just says to builders it is fine to cheat your customers and we will make sure that you can add to your bottom line with impunity.
Those who think this is just fine legislation will change their tune fast if they become a victim of a bad home builder. Consumer reports believes that a minimum of 150,000 homebuyers are victims each year. You could be next.
Lawsuits didn't hike home prices in California- greedy builders and inflated appraisals did. This is nothing but a build defective homes- pass em off and go card.
And guess what, when California passed builder legislation in favor of homebuilders under the same premise - home prices tripled.
Utah Legislators should be ashamed for allowing their pocket lining industries to once again berate their hardworking, taxpaying constituents that trusted and believed their campaign rhetoric.
Democracy is dead in America when government officals can be purchased with campaign donations. SO sad for the ordinary working people of this country. It is especially disgusting when we promote democracy around the world and don't even have it ourselves.
Has anyone actually read the bill? If so, I would like to know where to find it.
Among other issues from short cut building, my cousin suffered a cracked foundation that ruined the integrity of his home due to builder negligence. If this bill is really going to protect those kind of builders, our economy will only go further down the toilet.
However, if this legislation is there to protect quality builders from bogus claims, then it could help.
I guess it all depends on how the lawyers twist its meanings anyway.
