As long as law enforcement enforces these laws to include drug users on DUI's will it do any good to make Utah's roads safe. People drinking are not the only problem drivers killing and causing accidents. It's time to start convicting drug users of DUI along with those drinking. You can't enforce only part of a law and expect to have a fair and equal justice system. Targeting the drinkers only is discrimination and putting citizens at risk by not convicting the drug users of DUI's. They are breaking the same law equally and more dangerously than the drinkers because there are more of them. In Utah you can drug up and drive at any level of incapacitation, but don't have a beer, they'll want to kill you for it. Then if you are an illegal it's merely and inconvience to get caught.
I agree with your comments. I also strongly feel that we need stronger judges. I place a lot of the blame on judges. If you haven't experienced the courtroom then you would naturally vote "Yes" on all judges. But those who have experience the courtroom have learned that ALL judges really need to be removed and replacd. Vote NO on ALL judges. Send a message to our judicial system.
Police know that the motorist can refuse to perform the field sobriety tests (the eye scan, the walk and turn, and the one-legged stand). You can even refuse to blow in the small preliminary breath tester.
You can lose your license for at least 18 months if you don't submit to a blood, breath, or urine test back at the police station or jail.

I can't wait for the crack-down on people who use cell phones while driving. I'm sure everyone is familiar with the mounting research, but just in case, here is a 2006 quote from a U of U researcher, from the "Unews" website: "'We found that people are as impaired when they drive and talk on a cell phone as they are when they drive intoxicated at the legal blood-alcohol limit' of 0.08 percent, which is the minimum level that defines illegal drunken driving in most U.S. states, says study co-author Frank Drews, an assistant professor of psychology." This is one of numerous studies. The NHTSA and various private groups have duplicated these results.
So then, why do we insist upon strict punishments for DUI but turn a blind eye to other equally dangerous--and far more prolific--behavior on the roads? I speculate that it is because cell phone use is the more common behavior, and people are naturally reluctant to label themselves as deviants.
But remember that the next time you slowly drift into my lane without a signal, whilst blabbing away on your phone: you are as dangerous and immoral as a drunken driver.
Just say no to searches must be a part of the big problem...confronting lawmen and getting hit for it.
I say search em...get these killers off the road.
If you refuse to take field tests or give a blood, breath or urine sample you loose your license. It's called implied consent.
