Judge orders release of 5 terror suspects at Gitmo

Here's another Bush inspired learning moment. If we had given these captives due process in the first place there won't be no legal standing to release them. One more Bush failure.

The Judicial Branch of the government is now telling the administration exactly what the electorate told them on Election Day in 2006 and 2008; that subverting the time honored traditions, practices and Constitution of this country is wrong and simply won't be tolerated.

Sooooooooooooooooooooo a Judicial Activise Judge, and a federal judge at that,wants to "fight a war" does he or she, from The Bench, and remove this from The President now?, and has ordered the release of five Algerian terror suspects who have been held without charges almost seven years at Guantanamo Bay, however, these prisoner's have to BE DEEPORTED out of this Country, called America (not amerika) yet, and NO OTHER COUNTRY really wants them, that's why they were held there. So, seeing this Judge, wanted them free, why NOT he or she adopt them, taken them under their wings, and let them stay at their home 24/7, until a country if found?. Or better yet, let Obamacon, adopt them, and, let them babysit his kid's, for them, in the guest house, while Obamacon is running around the world 24/7 again, trying to save it from a world wide depression, they created while in Congress, until he stumbles on a small Country, like Cuba, Mexico, Russia, China, that'll take them there?. Either way, they should of kept them there at "Club Gitmo." That Judge was wrong here and knows it.

The Bush Administration has stated Guantanamo Bay must remain open in order to protect us from terrorists. Ironically, by trying to decrease terrorism through these detention facilities, we have actually accomplished the exact opposite. The families who the detainees leave behind are increasingly vulnerable to terrorist recruiters and often join the fight against the nation that wrongfully detained their father or brother. How do we expect other nations to adhere to the Geneva Conventions and respect human rights when we ourselves do not? If our enemies captured any American - military or civilian -would we want them treated in the same despicable manner as our Guantanamo detainees? Thankfully, President-select Barack Obama has stated he will close Guantanamo Bay and ban torture by the American military, thus ending these atrocious human rights violations.

The release was constitutional. Bush was forced to back off. Don't pin any of this action on Obama, he is not in office yet.

Ship them back to their countries. Sorry, guys, but you get them back. What you do is not our concern. They did not belong with us, so here, take them. Tough world out there, but... that is the way it is.

For the life of me, I can't understand why you liberals don't believe we are at war! What is it going to take to convince you? These people are not innocent victims of GWB! They are terrorists and they want to kill you! Turn them lose and they might succeed! But Obama doesn't believe we are at war either, so here we go. Brace yourself America, here they come unopposed and with no consequence of their attempts to murder innocent people! But hey, maybe they will vote democratic!

The U.S. District Judge in question is Richard J. Leon, a Bush appointee.

Isn't the Constitution wonderful in the checks and balances it brings to our democracy.

Thank goodness the judicial branch has finally found its backbone and is exercising its Constitutional prerogative by telling the Executive Branch that what they've done is not only wrong but unconstitutional as well.

You make good points but the judges need to be held accountable for abuses of power too. The less power anyone in a governmental position has, the more free law abiding citizens will be. According to some of our founding fathers, they believed this new government would not work if citizens would not govern themselves. They warned that if we ever got to a point where we would not govern ourselves, we would be destined to be ruled by tyrannts. In the opinion of some, that time is close as evidenced by activist judges overturning elections. No one can say that hasn't ever happened, it has happened and is about to again in the case of Prop 8 in Ca.
