The cyclist had a reflective vest on, reflectors on the bike, head lamp, and a flashing red light. The driver claims he didn't see the cyclist, but got out and looked and didn't see anything? He obviously 'felt' something if he stopped. Unlikely that the headlamp, flashing red light, reflectors, reflecting vest, etc. all disappeared in the light of the car's headlights, tail lights.
A one-year sentence was extremely lenient, to say the least, for negligent homicide, and then to have it reduced to 90 days, plus probation, is an insult to the severity of this crime, and to the family of this young man.
Why wasn't his license suspended, his car impounded and sold? Did he have a valid driver's license at the time? Was he a legal resident of the Utah? What about compensation to the victim's family?
So many questions, so few answers.
