Jury clears Ogden in woman's death

OGDEN — A jury has cleared the city of Ogden of any liability in the death of a 21-year-old woman stemming from a high-speed police chase.

The district court jury deliberated about seven hours before returning the verdict Thursday against the family of Jessica Nelson.

She and a passenger, 62-year-old Philemon "Bob" Ellis, were killed in the December 2005 crash after being broadsided by Eddy Bustos, who was being pursued by police.

The city's lawyers say the chase by officer Matt Jones had stopped moments before Bustos plowed into Nelson.

One expert told jurors that Jones' high speeds at the end of the chase were justified while another expert testified they posed an unnecessary hazard to the public.

Bustos was convicted of automobile homicide charges and sentenced to prison.
