Attorney departure delays Allgier date

A four-day preliminary hearing for Curtis Michael Allgier, who is charged with killing a corrections officer, has been delayed because a member of his defense team, Brennon Fuelling, is leaving.

Third District Judge Robin Reese on Monday granted a defense motion to reschedule the hearing, which was set to run Oct. 20-23, according to court documents. The judge set Oct. 20 for a scheduling conference to sort out where things go from here.

Allgier, 30, is charged with murder and other crimes in connection with the 2007 shooting death of corrections officer Stephen Anderson. Anderson was shot to death at a local hospital after he had taken Allgier from prison to the hospital for medical tests, according to charging documents. Police say Allgier then fled, commandeered a vehicle, led police on a wild chase throughout the Salt Lake Valley before Allgier was arrested at a fast-food restaurant.

Prosecutors say they will seek the death penalty if Allgier is convicted.
