LAYTON — A man and woman are behind bars after police say they kidnapped the woman's 1-year-old son from his court-appointed guardian.
David Wayne Hogan Jr., 19, and Kayla Roybal, 18, were booked into the Davis County Jail on Wednesday for investigation of child kidnapping, a first-degree felony. Hogan is also being held for investigation of theft, and Roybal is being held for investigation of reckless endangerment and failure to respond to an officer's signal to stop.
Layton Police Lt. Quinn Moyes said officers were called at about 5:30 p.m. by the child's grandmother, who has custody of the boy. The woman told authorities Roybal and Hogan arrived at her home while a baby-sitter was with the child and took him from the home.
"Kayla and David packed several duffel bags of clothing belonging to the child, along with his birth certificate and Social Security card," Moyes said.
The pair then left the home in an unknown vehicle with the child. "They were on their way out of the state to start a new life," Moyes said.
Police activated the Davis Area Child Abduction Response Team to assist in locating the child. Moyes said investigators with the team — a unit made up of officers from all Davis County police agencies — were able to make contact with Roybal. They used text messages to negotiate Roybal and Hogan's surrender about three hours after the alleged abduction took place.
The incident was the third CART deployment in Davis County since its creation in 2007, but Moyes said it was the first time the group had been called out to a "bona fide child abduction."
Moyes noted that Hogan pleaded guilty in August to one count of child abuse, a second-degree felony. He said the victim in that case was the same child Hogan and Roybal are accused of kidnapping.
According to court records, Hogan pinched and punched the boy in June as punishment after the child urinated on him. Hogan is slated to be sentenced on the child abuse charge on Oct. 22.
Roybal and Hogan remain in the Davis County Jail. Their bail has been set at $100,000 and $112,000, respectively.
