5 indicted in OxyContin robberies

A federal grand jury returned a four-indictment charge Wednesday against five people involved in two armed robberies in which the drug OxyContin was taken.

Mark Dubarry, 42, Shawn Spence Dubarry, 19, and Brittney Jerome Houston, 28, were charged in the July 13 robbery of the Rite Aid Pharmacy at 635 E. 3300 South. They face up to 20 years each in federal prison on that charge, as well as a seven-year mandatory minimum sentence on the related charge of using a firearm during the robbery.

All three, along with Jesse Spence Kirby, 25, and Justin Richard Hawkins, 19, are similarly charged in the Aug. 23 theft of more than $3,000 worth of the powerful narcotic from the same pharmacy. The Dubarrys and Houston face 25-year mandatory minimum sentences if convicted on both firearm counts.

Members of the group pointed a handgun and a paintball gun at employees and customers during that robbery and met afterwards in a Midvale hotel room to divvy up the pills, according to court papers. They were arrested Aug. 26.

The indictment does not mention the Aug. 22 robbery of the Rite Aid at 2378 Fort Union Blvd., which was cited when the group was initially charged last month.

The defendants are scheduled to be arraigned Friday before U.S. Magistrate Judge David Nuffer.

Mark Dubarry's wife, Nicole, who was also accused in the robberies, committed suicide last week in the Salt Lake County Jail.
