Utility allowed to proceed in Willard

A temporary restraining order has been issued by the 1st District Court that allows Rocky Mountain Power to proceed with necessary construction activities in Willard associated with the company's Populus-to-Terminal transmission project.

The order was granted Thursday in recognition of a stipulation reached between Rocky Mountain Power and Willard, according to a utility news release.

The release stated that the order allows Rocky Mountain Power to begin construction activities such as building access roads and concrete pads near proposed utility-pole locations and performing survey work detailed in plans the company submitted to the city in Box Elder County.

On Thursday, Rocky Mountain Power filed a lawsuit contending that Willard illegally terminated a conditional-use permit to construct electric transmission lines for a proposed $4.1 billion project through the city.

The city planner told the Deseret News that the utility did not comply with the city's laws.

The temporary restraining order will be in place until a preliminary injunction hearing scheduled in late July, the company stated.

The order also requires both parties to work in good faith to reach a comprehensive settlement agreement.
