2010 trial set in excessive force lawsuit against Millard County deputy

A 2010 trial date has been set for a lawsuit against a Millard County sheriff's deputy accusing him of excessive force.

During a hearing in U.S. District Court in Salt Lake City on Wednesday, a judge set a January 2010 trial in Ty Pikyavit's lawsuit against the Millard County Sheriff's Office and deputy Clete Carter. Pikyavit, 19, admits to drinking, but says the deputy shoved his head into the side of a truck and then threw him to the ground.

In a response to the lawsuit, Carter's attorney said Pikyavit was resisting arrest and denied using excessive force.
