In all the comments I've read about Proposition 8, there has been one thing completely misunderstood by both sides: Same-sex marriage is not the same thing as gay marriage. The two have become interchangeable, which is unfortunate.
Judicial decisions that declare same-sex marriage as legal do so based on the constitutional mandate that gender is a protected status. Same-sex marriage and opposite-sex marriage differ on one thing: gender. Many judges understand the difference, which paints them as "activist" by a misinformed populace when they vote to allow same-sex marriage.
