Details of carjacking and fatal shooting are released

Before police shot and killed a West Valley man involved in a robbery and carjacking in October, he yelled, "I also have a gun. Let's play," according to an affidavit for search warrant filed in 3rd District Court.

Police also seized a Glock 27 handgun, ammunition and stolen items from the white Nissan Altima that Marcus S. Agrillo, 38, was sitting in at the time of his death, according to the affidavit.

On Oct. 17, Agrillo along with three others robbed at gunpoint a painter they lured to an abandoned house at 1825 W. 3300 South under the guise of hiring him for a job, police said. They stole the man's wallet, money, cell phone, clothing, laptop computer, chop saw and his 1997 Ford Expedition.

A police officer later spotted the abandoned Ford Expedition in a field, police said. He saw three people pull up to the vehicle in a white Nissan Altima so one could retrieve some cigarettes, police said. After a brief chase, police cornered the Altima on a dead-end street at 1300 West and 2200 South.

Two of the occupants — Ryan Scott Bills, 36, and Alexia Dawn Walker, 28 — surrendered, but Agrillo refused. Officers deployed pepper ball rounds to get him out of the car, but it didn't work.

According to the affidavit, Agrillo threw an empty holster from the vehicle and yelled, "I also have a gun. Let's play." He raised his hands at police, and six officers from various agencies shot and killed him.

In mid-November, the Salt Lake County district attorney cleared officers in the shooting death, saying Agrillo posed a "threat of death or serious bodily injury." Agrillo had been released from the Utah State Prison in 2007 after serving a sentence for drug possession, state correction officials said previously.

Bills, Walker and a fourth person, Kurt Smith, 41, each face charges of aggravated robbery and obstruction of justice and are scheduled to appear in court later this month.
