Orem man arrested in case involving sex with 15-year-old

PROVO — An Orem man was arrested after police say he went to the home of a 15-year-old girl he met at the mall and had sex with her.

Jonathan Andrew Ruiz, 21, was arrested on Friday for investigation of two counts of unlawful sexual activity with a minor.

Ruiz met the 15-year-old girl at the Hot Topic store at the University Mall in Orem, according to a police affidavit filed in 4th District Court. The two exchanged phone numbers and communicated back and forth by text. The victim said Ruiz knew she was only 15 years old, the affidavit states.

On June 23, police say, Ruiz went to the girl's home in Orem. The girl's parents weren't home, but her two younger sisters, 13 and 10, were.

The victim said when Ruiz came over, he took her into her bedroom, held her down and had sex with her twice, the affidavit states. The teen told police she tried to fight him, but Ruiz was too strong. Both younger sisters heard her screams, the report states.

When police contacted Ruiz, he said the sex was consensual and they went into her room as part of a tour of her house, according to the affidavit.

Ruiz is being held in Utah County Jail in lieu of a cash-only bail of $7,500.
