CALDWELL, Idaho (AP) Third District Judge Renae Hoff has sentenced a Caldwell man to at least six years in prison for throwing his girlfriend's baby down five stairs.
Miguel Rodriguez, 22, was sentenced to 10 years but will be eligible for parole after serving six years. Prosecutors originally charged Rodriguez with attempted murder, but he pleaded guilty to a reduced charge of felony injury to a child in November.
According to court records, Rodriguez confessed to throwing 6-month-old Oscar Tea down the stairs to a concrete floor because he was angry with the child's mother. The boy suffered serious head injuries and is now in foster care.
The child's mother, Kimberly Tea, was sentenced to at least three years in prison for felony injury to a child because she failed to report the abuse.
