Save Our Canyons sued the city, went to the state courts with the case and eventually ended up at the Supreme Court, where the high courts ruled that Sandy must hold the referendum.

Sandy voters, however, ended up approving the zone change in a tight vote. Today the development, Quarry Bend, includes a Wal-Mart and Lowe's Home Improvement store.

CRT hopes their group will have a better outcome. All of their legal fees are paid through donations from the group and other community members.

"It's going to make a very big impact, and we want to make sure we put it in the right place," Pugh said. "We want to study all of the alternatives and be educated on what really will be most efficient, most cost-effective, attract the most riders, and we don't think that kind of research has been done."

Draper City Attorney Doug Ahlstrom could not be reached by press time Friday. He said in August after CRT filed the appeal with the Supreme Court that he was prepared to fight.

"Obviously, I feel the judge's ruling was proper. I'll be excited to argue that to the Supreme Court," he said.

Although the case was originally CRT vs. Draper, UTA will also give its input in the case because it filed to be an "intervenor" earlier this summer.
