Corrections officer on leave, facing 5 felony sex charges
A state Department of Corrections officer is on administrative leave after being charged with five felony sex offenses.
Salt Lake County prosecutors filed two first-degree felony counts of object rape, one first-degree felony count of rape and two second-degree felony counts of forcible sexual abuse against Matthew D. Hogue.Hogue, 28, is a six-year veteran of the Corrections department.
The five charges were filed Nov. 2 in 3rd District Court as the result of an alleged encounter between Hogue and his girlfriend.
A photo developing business in Sandy contacted police last month after a roll of film they received for processing revealed photos of an unclothed woman.
The woman, who appeared to be either unconscious or dead, had been posed engaging in a sex act with varying objects.
The business contacted police, who tracked down the woman and questioned her about the photos. She said she was unaware they had been taken.
A joint investigation with the Salt Lake County Sheriff's office led them to Hogue, who allegedly took the photos in early October. He said he had taken the pictures because he was mad at his girlfriend. He told officers the woman was unconscious.
Under Utah law, sexual intercourse or other touching becomes illegal if it is done without the victim's consent, if the victim is unconscious or if the victim is physically unable to resist.
Hogue appeared in court Friday on the charges and is scheduled to return Nov. 19 to enter a plea. He has been released from the Salt Lake County Jail on bail.
