City may alter open-records ordinance

Phelps said he loved teaching, and being released as stake president was embarrassing, but he remains a faithful member of the church.

"I gotta live with the consequences. I taught that as a seminary teacher," he said. "If you make choices, you have to live with the consequences."

Since leaving his teaching job, Phelps has been working at R.C. Willey in Syracuse selling furniture. He also recently got his real-estate license and has begun selling homes.

Meanwhile, the City Council plans to consider a change to its records ordinance, which currently states anyone who is denied a records request may appeal to the city manager. If the city manager denies the appeal, the requestor may appeal to the City Council and then district court, if denied again. The ordinance was last updated in 2000.

City Recorder Nancy Dean said she will be drafting a new ordinance to make the city's code correspond with Utah State Code, which has a different appeals process.

Utah Code states anyone who is denied a records request by a city manager may appeal to the State Records Committee, which is part of the Utah State Archives.
