Former Utah Highway Patrol Lt. Fred Swain has entered a not-guilty plea to a charge of driving under the influence, a class B misdemeanor, in Draper Municipal Justice Court.
Swain, 41, will next appear before Municipal Court Judge Daniel Bertch on Aug. 10 for a pre-trial conference.
Swain, who formerly headed the highway patrol's DUI team, resigned June 30 from his law-enforcement position following a June 23 accident in which he crashed into a barricade on Bangerter Highway with his unmarked cruiser. When he resigned, he acknowledged he had a drinking problem.
