Attorneys to review Schanze video clips

WEST JORDAN — Lawyers on both sides in the case of Dell Buck Schanze must review two television-news video clips together and see if they can work out an agreement as to whether they should be admitted into evidence at Schanze's upcoming trial, said 3rd District Judge Royal Hansen.

Hansen directed prosecutor Chris Bown and defense attorney James "Mitch" Vilos to jointly review two news clips from KTVX Channel 4 and report back to the judge if they can agree whether the material can be admitted. Otherwise, Hansen will issue a ruling.

The attorneys argued motions Friday on such things as jury instructions as they prepared for Schanze's trial, which is set for May 10-12.

Schanze has been charged with three misdemeanors: threatening use of a dangerous weapon in a fight, reckless driving and written false statements. They stem from a May 21, 2005, incident in which angry Draper residents followed Schanze and his 8-year-old daughter from their neighborhood, claiming he was speeding, and words were exchanged after Schanze stopped.

Court documents say one individual picked up a "medium-sized rock" and threatened to break the tail lights of Schanze's Jaguar. Schanze then "drew" a handgun from a front pant pocket, "exhibited it" and "pointed it" at the man, court documents state.

Bown wants the news footage presented to a jury because Bown maintains Schanze's comments to a reporter contradict what he told police.

Vilos objects, saying the video clips do not show the original questions that were asked and are therefore not reliable.
