No charges for ex-IRS agent - if he repays $125,000

Utah County prosecutors will drop a second-degree felony theft charge against a former IRS agent and Salt Lake tax attorney if he repays $125,000 to two Mapleton ranchers.

Craig P. Orrock, 50, who now practices law in Las Vegas, was scheduled to stand trial on the theft charge in December. However, he entered into a diversion agreement with prosecutors Friday and the charge was dismissed.

Under the agreement, Orrock will pay a minimum of $125,000 to John and Richard Childs within three years. If he does so, the case against him will be dismissed. Orrock's no contest plea will be held in abeyance until he completes his agreement.

Orrock also agreed that he is responsible to repay the Childses an additional $175,000, although that is not part of the plea in abeyance agreement. By agreeing to a judgment by confession, Orrock can be held liable to pay the additional money in civil proceedings.

Orrock persuaded the Childses in 1990 to place more than $1 million in his care, court documents state. The money was from the sale of cattle and land and was supposed to be deposited into trust accounts.

In 1993, the Childses discovered that Orrock had allegedly withdrawn money from the account without notifying them, court documents say. When the Childses attempted to contact Orrock, they discovered he had closed his Salt Lake office and moved to Nevada. He was arrested there after he was charged with the theft in 1996.
