Labor lawsuit hits employer

The U.S. Department of Labor has filed a federal suit against the owner of a Utah children's clothing store for alleged labor violations, including failing to pay employees above minimum wage and failing to pay workers overtime.

The suits allege that Toha Quan, also known as Jimmy Quan, violated provisions of the Fair Labor Standards Act by unlawfully withholding overtime compensation from his employees at the Jolene's clothing store in Draper.

The suit lists some 17 employees who are allegedly owed a total of $11,464 by Quan for unpaid minimum wage and overtime compensation. The U.S. Department of Labor also alleges that Quan failed to keep records of his employees, their wages and hours worked each workday and workweek as well as other information.

In addition to asking the court for recovery of unpaid wages, the labor department is also asking for damages. If the court does not grant damages, the labor department has asked for an award of interest on the back pay.
