A difference between the driving privilege card for illegal immigrants and the one for legal immigrants, as dictated in HB223, is that for legal immigrants, it's valid for five years or until their visa expires. Those using ITINs must renew it every year.

Which brings up another issue.

In the text of HB223, Oda's bill, it refers to a driver's license throughout, until one reads the last section.

At the bottom of the bill it states that if SB227 and HB223 are both passed and signed, which they were, the language of SB227 supersedes that of HB223.

That means, Oda said, HB223 adopts a driving privilege card in each instance where the bill states driver's license. That language allows legislators to get away from the perception of profiling the privilege card holders, Oda said.

If SB227 hadn't passed, McCulloch's wife would have been able to have a driver's license come July 1. Unfortunately for them, it's not the case.

"It bothers me," McCulloch said. "Unbelievable."
