NETS RELEASE HARRIS: Backup guard Lucious Harris was waived by the New Jersey Nets on Wednesday. Harris averaged 7.7 points, 1.6 assists and 2.6 rebounds in 456 games since being acquired in June 1997 as part of an eight-player trade with Philadelphia. His most productive season in New Jersey was 2002-03, when he averaged 10.3 points. He played a big part in helping the Nets won two Eastern Division titles.

HEATLEY ARRAIGNMENT WAIVED: A judge has waived the arraignment for Atlanta Thrashers forward Dany Heatley, who has been charged with vehicular homicide and five other counts in the 2003 wreck that killed a teammate. Judge Rowland Barnes is allowing Heatley's lawyers to enter an innocent plea in writing. Heatley's next court date is scheduled for late November. Police say Heatley was driving his black Ferrari convertible between 60 mph and 90 mph on a curved road in a residential area when it ran into a brick pillar and iron fence on Sept. 29, 2003. Dan Snyder, 25, died after six days in a coma, and Heatley broke his jaw and tore two ligaments in his knee.

TOP SEED FALLS: Top-seeded Carlos Moya was upset by French qualifier Jo-Wilfried Tsonga 6-3, 6-3, in the first round of the China Open on Wednesday. Tsonga, a 19-year-old former U.S. Open junior champion, was playing in his first career ATP level match after two Challenger titles this year. Moya, ranked No. 4 in the world, committed numerous errors and had eight double faults in the match that dragged on through a lengthy rain delay.

RUBIN UPSET: Italy's Tathiana Garbin upset American Chanda Rubin 6-1, 6-4 Wednesday in the first round of the Wismilak International. Second-seeded Ai Sugiyama of Japan was also upset, as countrywoman Aiko Nakamura beat her 6-4, 7-6 (1).
