Senator caught in newspaper dispute

"It was intended to not affect any pending litigation dealing with that issue" in the Deseret News-Tribune legal case, Valentine said.

But the bill also makes the law retroactive to 1990. Valentine said the Tribune's attorneys were concerned that clause would make their Supreme Court appeal moot. Valentine said when he decided to present the bill, he did not know the Tribune had appealed Memmott's decision to the Supreme Court.

Lawmakers left the hill Wednesday for a four-day break and will return Monday, hoping to end the session then. Valentine said he will think about his bill over the weekend and decide whether to continue pushing it or send the issue to interim study.
