Jury awards $3.1 million in house-settling case

PROVO — A jury says a Lindon couple should get $3.1 million in a civil case over problems with their house.

Mark and Marilyn Hess sued developer Canberra Development, and owner David Allen, after their house started to sink.

Stephen Quesenberry, attorney for the Hesses, said the couple was never given an engineering report that the home was built on collapsible soil.

The jury reached its verdict late Friday night.

The jury divided responsibility between Allen, his company and contractors.
