Man gets 60 days in jail for probation violation in Provo
Adult Probation and Parole requested an arrest warrant be issued for Forrest Barth, 22. Last August, Barth pleaded guilty to felony robbery and misdemeanor sex-related and drug charges and received probation and jail time. After serving time in jail, Barth was released to begin treatment in the Fremont Community Corrections Program when a spot became available.
On June 25, Barth approached Fremont staff and admitted to engaging in sex acts with his older roommate, according to a July 7 report filed by Adult Probation and Parole. In an affidavit, his probation officer said his sexual encounter violated the terms of his probation in that he, "failed to enter into, participate in or complete a program, counseling or treatment as directed, in violation of a special condition of the Probation/Parole Agreement."
On Wednesday, 4th District Judge Claudia Laycock agreed to follow a recommendation from Barth's probation officer and ordered him to serve 60 days in jail before returning to successfully complete the treatment program at Fremont.
Barth was arrested in May 2007 when police were called to the Provo residence of a 17-year-old girl. Police said Barth, who was arrested just a week before for stalking the same girl, entered her home through an unlocked door in the early morning hours. They said Barth sneaked up to the girl's bedroom and, after taking off his clothes, attempted to have sex with her. The girl's screams awakened her 22-year-old brother, who restrained Barth for police. After the initial arrest due to the stalking, Barth was released from jail because of a communications error between court employees and the jail.
Barth was initially charged with aggravated burglary, attempted rape and interference with a police officer. Those more serious charges were reduced to burglary, attempted unlawful sexual conduct with a 16- or 17-year-old and possession of a controlled substance. Defense attorneys said Barth was under the influence of the drug Ketamine when he entered the girl's home.
