Girl convicted in toddler's driveway death
Court records from the girl's hearing in Duchesne's 8th District Court revealed the judge ordered the girl removed from her home because it "was in the best interest of the minor." The records showed that it was also because of a number of offenses dating back to 2007, including aggravated assault with a weapon, harassment, destruction of property and making threats.
The girl was first charged with manslaughter and being an unlicensed driver in the May 15 death of 22-month-old Franchesca Isabel Montes. Roosevelt police said the girl hit and killed Montes as she pulled out of the driveway at the little girl's home.
At a hearing on Tuesday, the manslaughter charge was reduced to a negligent homicide. Allegations against the 14-year-old girl were found to be true and she was ordered to serve detention, probation and community service. She was also placed at a facility in Forest Ridge, Iowa. Her parents were ordered to pay child support.
"(The girl) has had 10 delinquent offenses which were included in 10 episodes referred to the Juvenile Court," the court records said. "These offenses included 1 felonies (sic) and 9 misdemeanors or infractions. None of these episodes consisted of 2 or more offenses."
The case summary said the girl was first placed in juvenile detention in February and spent 154 days there.
"Since being placed on probation, 5 misdemeanors or infractions have been reported to the court," it said.
The girl's aunt, Nicole Annette Rodrigues, 33, is facing a second-degree felony manslaughter charge, as well as misdemeanor charges of failure to remain at the scene of an accident and allowing an unlicensed person to drive. Police said that after the accident, Rodrigues left the girl with the dying toddler and fled the scene.
She is scheduled to appear in court for a hearing on Thursday.
