Eagle Mountain pair appear on 3 felony fraud counts

Culbertson's real-estate license was revoked Oct. 17, 2007, and he will potentially face sanctions from the Utah Bar if he is convicted of a felony or any crime related to dishonesty, Skordas said.

Kathleen Culbertson still holds a mortgage loan officer license, said Jennifer Bolton, public information officer for the Department of Commerce.

According to a stipulation and order before the Utah State Real Estate Commission, Culbertson admitted to using information from a "straw buyer" to purchase a home in Eagle Mountain, and then forged signatures.

He told the commission he got an appraisal of a different home in Eagle Mountain so he could inflate the price of the property, then used that price to receive "money in excess of the sales price and (acquire) cash at closing for his personal benefit," according to the stipulation.

With the revocation, Culbertson agreed to give up his license and pay a $40,000 civil penalty to the division — $30,000 of which will be suspended if he cooperates with the ongoing investigation, which he has, Skordas said.
