Smoking in cars may face limit

The proposed ordinance in Weber and Morgan would prohibit smoking in parks, playgrounds, recreational areas, golf courses, amphitheaters, fairgrounds, sport fields, amusement parks, swimming pools, plazas, gardens, cemeteries, bleachers, boweries, trails and skate parks.

Kristine Jones, health educator with the Weber-Morgan Board of Health, said the proposal is very similar to what Davis County has already passed. The board used Davis' regulations as a guide.

If approved, the penalty for violating the ordinance would be $25 for each offense. Any peace officer and code enforcement officer may enforce the law.

"It's more of a self-enforcing policy," Jones admitted. "Most people will be compliant."

A public hearing on Weber-Morgan's ordinance is set for 5 p.m. Monday at the Health Department Building, 477 23rd St., Ogden.

West Valley City, which passed an outdoor smoking ban in October that covers all outdoor public areas except golf courses, has not yet issued any citations nor has it received complaints about people breaking the law, a spokesman said.

Murray officials passed a no-outdoor-smoking ban in June. No citations have been issued there, either, says Jan Wells, Murray chief of staff.

Sandy passed a resolution asking residents not to smoke within 50 feet of organized sporting events, playgrounds and pavilions May 5, 2006. The city decided not to enact an ordinance because it didn't want to deal with the enforcement issue unless outdoor smoking became more problematic, said Parks and Recreation director Nancy Shay. So far, the city hasn't had any problems but has posted dozens of signs in areas affected by the resolution.
